Terms of Service

Article 1 — Application

These terms set out the conditions of use for Typing Musou (the 'Service') between every user of the Service and the operator (Typing Musou Operations, the 'Operator'). The Service is provided for users located in Japan, and these terms are operated in accordance with Japanese law. By using the Service, users are deemed to have accepted these terms.

Article 2 — Registration & eligibility

The Service can be used in guest mode without an account, including ranked matchmaking, friends, and leaderboard registration. Battle records, items, and rating earned as a guest are saved to the server, but carrying that data across devices or browsers requires signing in with a Google account. The Service is open to users of all ages; children under 13 must use the Service only with the consent and supervision of a parent or legal guardian. Where a minor agrees to these terms, the minor must use the Service after obtaining the consent of their legal guardian. Where the Service is used through a school under an agreement with that school or its founding body, the school — which stands in a position to decide on the use of educational tools on the guardian's behalf — is responsible for explaining the Service to guardians and obtaining any consent required, and the consent under this Article is treated as having been obtained through the school for the students concerned. Conditions specific to use through a school are set out in Article 10.

Article 3 — Account management

Users are responsible for managing the Google account used to sign in to the Service. Except in cases of the Operator's willful misconduct or gross negligence, the Operator is not liable for damages caused by compromise of Google credentials or by user-disclosed information (username, friend code, etc.) within the Service.

Article 4 — Prohibited conduct

Users must not engage in any of the following while using the Service:

  • Acts that violate law or public order and morals
  • Unauthorized access, cheating, use of macros/bots or other automation tools, and rating manipulation including intentional losses or collusion
  • Harassment, nuisance, defamation, or impersonation toward other users
  • Posting inappropriate content in usernames, friend codes, the inquiry form, etc.
  • Interfering with the operation or servers of the Service, or placing undue load on them
  • Reverse engineering, decompiling, or otherwise analyzing any part of the Service
  • Abuse of multiple accounts, including bulk registration over short periods
  • Unauthorized reproduction, redistribution, or commercial use of Service content (characters, text, UI, etc.)
  • Disclosing or sharing a class join code in the school edition with anyone not enrolled in that class, or joining a class in which you are not enrolled
  • Impersonating another student in the school edition, or entering a false roster number or in-class display name
  • Taking another student's learning records or submissions, learned through the school edition, outside the class or publishing them against that student's wishes

Article 5 — Username screening

To determine whether a username a user sets or changes falls under the prohibited conduct in the preceding Article, the Operator sends that username to an external AI service (an API provided by OpenAI, L.L.C.) for automated screening. The username screening under this Article is the sole case in which the Service sends information to an external AI service: learning records, assignment completion status, submissions, assessments, keystroke data, battle records, inquiry content, and roster information are never sent to any external AI service (this is equally true when using the school edition). Only the entered username text is sent; account identifiers, email addresses, and similar data are not. Content sent is used to train that company's models (details, and the handling if you do not want your input sent, are set out in Article 8 of the Privacy Policy). Users must not include their real name, address, phone number, or other personal or sensitive information in their username. The automated screening is advisory only: passing it does not warrant that the name complies with these terms, and the Operator may take corrective action under Article 9 if a name that passed screening is later judged inappropriate. Username changes are limited to 3 per rolling 24 hours; an attempt rejected by the automated screening also counts toward that limit.

Article 6 — Items & in-game currency

Items in the Service (characters, icons, titles, effects, etc.) are acquired with in-game currency. In-game currency is a virtual good that cannot be exchanged for real money, and the Service does not currently offer paid-currency purchases. No path exists by which a user — including a student using the school edition — can make a payment within the Service, and the Operator does not collect any consideration directly from users (fees for the school edition are paid by the school under its agreement with the Operator). No compensation for in-game currency or owned items will be provided upon account suspension, deletion, or termination of the Service.

Article 7 — Intellectual property

All copyrights and other intellectual property rights in the Service (characters, illustrations, music, text, logos, source code, etc.) belong to the Operator or the rightful owners. Users are granted only a non-exclusive, non-transferable license to use the Service for private purposes; unauthorized reproduction, redistribution, modification, or commercial use is prohibited. Copyright in content submitted or transmitted by users to the Service (usernames, inquiry contents, and other user-input text; 'User Content') is retained by the user or the rightful owner; however, the user grants the Operator a free-of-charge, non-exclusive license to use User Content (including reproduction, modification, and display) to the extent necessary for providing and operating the Service, improving quality, responding to abuse, and complying with applicable law.

Article 8 — Changes & suspension

The Operator may change, add, or remove Service content (game balance, item prices, season structure, rating mechanics, etc.) without prior notice. The Service may also be suspended temporarily for maintenance, incident response, or outages of external services (authentication, database, analytics, etc.).

Article 9 — Account suspension / deletion

If a user is judged to have violated these terms, or for accounts inactive for an extended period, the Operator may without prior notice suspend or delete the account or correct records such as battle history, rating, and owned items. A user subject to suspension or correction may file an objection to such action via the contact page; the Operator will examine the objection in good faith and respond within a reasonable period. Users may delete their own account at any time from the "Delete account" control in the settings screen. Deletion takes effect immediately and cannot be undone. For what is retained after deletion (anti-cheat logs, reports, support enquiries, enrolment records, submissions and grading records in the school edition, and so on) and for retention periods, please refer to Article 10 of the Privacy Policy. Handling specific to the school edition, including the restriction on deleting teacher accounts, is set out in Article 10 of these terms.

Article 10 — The school edition

Under an agreement with a school or its founding body (together, the 'School'), the Operator provides classes, assignments, the gradebook, Google Classroom integration and related features (the 'school edition'). This Article sets out conditions specific to the school edition; matters not covered here are governed by the other provisions of these terms. The handling of personal information in the school edition is set out in Article 11 of the Privacy Policy and in 'Handling of personal information in the school edition'.

  • The parties to an agreement concerning the school edition are the Operator and the School, not individual students or teachers. Whether, to what extent, and for how long the school edition is provided is determined by that agreement.
  • Teachers shall keep class join codes from becoming known to anyone not enrolled in the class, and shall keep rosters and roster numbers accurate. Before a student joins a class, the teacher shall inform the student what will be visible to the class teacher and other teachers at the school — that learning records including practice done at home will be shown, and that the in-class ranking will be shown to the other students in the class.
  • The scores, completion status, and growth records produced by the school edition are material to assist a teacher's assessment. Final judgement on, and accountability for, the assessment of a student rests with the teacher and the School, and the Operator does not warrant that these outputs are fit for any particular assessment.
  • A student's account belongs to the student. Joining a class places under the School's control only the fact of enrolment and the learning records within the school edition; the account itself, in-game currency, owned items, and rating continue to belong to the student. Students may continue to use the game portion of the Service as before while enrolled in a class.
  • Teachers may export rosters, progress, and the gradebook in CSV format while enrolled and on termination. On request from the School at termination, the Operator will supply that School's data in CSV format.
  • On cancellation of the agreement, the Operator does not delete school-edition data. What stops appearing is the school screens only; students' own accounts and gameplay records are unaffected. Only on an explicit request from the School does the Operator delete that School's school-edition data, and it will report having done so.
  • The Operator may provide the school edition on a trial basis. The period, scope, and whether the trial is free or paid are set out in the individual agreement, and a trial may be ended by agreement between the Operator and the School.
  • A teacher account that owns a class cannot be deleted until the class is deleted or handed over to another teacher, because the class records belong to every enrolled student.

Article 11 — Disclaimer

The Operator does not warrant that the Service is free from factual or legal defects (including safety, accuracy, fitness for a particular purpose, security, or freedom from errors or bugs). Except in cases of the Operator's willful misconduct or gross negligence, the Operator is not liable for any damages arising from use of or inability to use the Service, data loss, disputes with other users, or failures of external services. To the extent any provision of this article is restricted in effect by the Consumer Contract Act or other mandatory law, it does not apply within that restricted scope. The allocation of liability between the Operator and a School in respect of the school edition is governed by their agreement.

Article 12 — Amendments

The Operator may amend these terms when deemed necessary. Where the amendment conforms to the general interests of users, or where it is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other relevant circumstances, the Operator may amend these terms pursuant to Article 548-4 of the Japanese Civil Code. Significant amendments will be announced on the Service together with the effective date no later than 14 days before the effective date. Continued use of the Service on or after the effective date constitutes acceptance of the amended terms.

Article 13 — Governing law & jurisdiction

These terms are interpreted under Japanese law. Any disputes related to the Service shall be subject to the exclusive jurisdiction of the court in the Operator's location as the court of first instance (provided that, for consumer contracts, this is limited to the extent permitted by the Code of Civil Procedure and other applicable laws). Disputes between the Operator and a School in respect of the school edition are governed by any jurisdiction clause in their agreement.
